    1. Call the police, request medical help if needed, and ask that a crash report be written. A crash report is often beneficial for your claim; therefore, it is important to be as thorough as possible. Keep the conversation with the other party to a minimum and let the officer gather information from both sides.
    2. Take photos of the scene, any property damage, and the license plate of the other vehicle involved. While your memory may fade, photos do not. If there are witnesses at the crash site be sure to obtain their contact information.
    3. Seek medical treatment immediately. Setting and attending an appointment within 1 to 3 days of the accident is ideal. You may not immediately feel any pain or discomfort, however, symptoms of accident-related injuries may take some time to develop. Additionally, treatment within an immediate timeframe is important to preserve potential insurance benefits.
    4. Do not post on social media. While it may seem reasonable to post about your life online, insurance companies have the means to access your online content could use it against you during litigation.
    5. Talk to an attorney, but remember, not all attorneys are the same. It is imperative that you seek a knowledgeable attorney to handle your claim. Do your research by looking at their website, social media and speak to others.

At The Modern Law Group, our attorneys are experienced, aggressive, and know how to maximize your claim.

    1. Open a claim with your insurance company. HOWEVER, if the adjuster asks you if you are injured, make sure you tell them you would like to consult with an attorney, and do not provide any additional information. Let the attorneys at The Modern Law Group speak on your behalf.
    2. Do not give the insurance company any statements. Insurance companies are not your friend, and that includes your insurance company as well! Don’t let them trick you into saying something that can hurt your claim or can be used against you in the future. Let them know you are speaking with an attorney and to direct all questions to them.
    3. Start treating with a doctor right away! If you are the owner of any insured vehicle in Florida, you have 14 days to being treatment and potentially qualify for insurance benefits to cover your medical expenses or lost wages. Don’t miss out!
    4. Once you get to the doctor’s office be sure to be detailed and descriptive. Inform the doctor about any and all injuries, no matter how big or small, so that they are documented and treated appropriately. Try not to cancel or miss any appointments as that can negatively impact your case.
    5. Provide the doctor’s office with all applicable insurance information. Be sure to include your claim number, auto insurance policy information, and health insurance if applicable. This will help to avoid medical billing problems in the future.

    1. Review the crash report or incident report to refresh your memory about how the accident occurred. Take time to think through what happened to your body at the time of impact. For example, were you thrusted back and forth in your vehicle? Did you hit your head on any part of the vehicle? Did you feel immediate pain? Did you lose consciousness?
    2. Review your responses to interrogatories. At the time of your deposition, it is likely you and your attorney have participated in the “discovery process.” Be sure to review your responses and be familiar with your answers as they are considered sworn testimony. Many of the deposition questions will be based on your responses and insurance companies are looking to find inconsistent statements in your testimony.
    3. Reflect on how the accident has impacted your life. For example, does it hurt to stand in the kitchen and cook a meal? Are you no longer able to work out as vigorously as you once were? Have your relationships suffered as a result of the limitations presented by your injuries? Keep mental notes about these hardships and be sure to be descriptive during your deposition.
    4. Prepare with your attorney. Be sure to make all scheduled preparation appointments and review all the documents provided to you.

At The Modern Law Group, we make sure that we provide our clients with a copy of all statements made during litigation to ensure they are adequately prepared.

  • Never drive under the influence of alcohol or drugs! However, if you are pulled over and suspected of driving impaired, here are helpful tips.

    1. Do not argue with the officer. Being combative could be used as evidence to support their claim that you were under the influence. Be polite and professional.
    2. You have the right to remain silent and we highly recommend that you exercise that right! Any statements can and will be used against you. If you chose to speak, give careful answers to the questions, and remember that you are likely being audio and/or video recorded.
    3. Field Sobriety Exercises are VOLUNTARY! You are not required to do them but if you do, they will be used against you.
    4. Breathalyzers are also voluntary, however, if you refuse to submit to a breath test, you could face criminal penalties under certain circumstances as well as suspension of your driver’s license.
    5. Call an experienced attorney if you are arrested for DUI!
